Current Bonnie Brae Forest Manor Sanitary District Projects

WATER AND SEWER RATE INCREASE/ARBITRATION HEARING RESULT
Water and Sewer rates for Bonnie Brae residents will be subject to an increase beginning December 15, 2010.  Water usage rates will increase from $3.37 per month to $4.53 per month, and sewer rates from $3.37 per month to $4.38 per month.  In addition, the surcharges for water and sewer will increase from $4.00 per month to $14.50 per month.

This increase results from the recent decision issued by the Arbitrator in the arbitration hearing conducted between the City of Lockport, Bonnie Brae Forest Manor Sanitary District, and Lockport Heights Sanitary District.  The rate increases proposed by the City were opposed by Bonnie Brae Forest Manor Sanitary District Trustees and the Lockport Heights Sanitary District Trustees.  Since agreement could not be reached, the matter was presented to a Arbitrator jointly selected by the parties.  A day-long arbitration hearing was held on September 20, 2010, during which each party was given the opportunity to offer the testimony of witnesses, present documentary evidence, and make arguments for and against the proposed increases.

On November 8, 2010, the Arbitrator issued a 46-page opinion.  The Arbitrator ruled first that due to increased operating costs and the compelling need for capital improvements, that a rate increase was justified.  Furthermore, the Intergovernmental Agreement joining Bonnie Brae Forest Manor Sanitary District and the City of Lockport required that rates throughout all of the Districts are required to be uniform (with the exception of non-metered accounts).  As a result, the more moderate increases proposed by and for Bonnie Brae Forest Manor Sanitary District were disallowed and the higher increases proposed by the City were imposed for all metered accounts.
